How to generate your Debt Validation Request letter

Five steps, usually under ten minutes total.

This letter is a timely written request for validation of the alleged debt described in your initial communication to me dated [date].

I dispute this debt and request that you cease collection activity until you have provided the following, as required by the Fair Debt Collection Practices Act, 15 U.S.C. § 1692g:

  1. The amount of the alleged debt.
  2. The name of the original creditor.
  3. Verification or a copy of any judgment.
  4. Evidence that you are the current owner of the debt or are authorized to collect on behalf of the owner, including a chain-of-assignment record.
  5. A copy of the signed agreement or other instrument creating the alleged debt.
  6. A complete itemized accounting showing how the alleged amount was calculated.

Until validation is provided, you must cease all collection efforts, including phone calls and credit reporting, as required by 15 U.S.C. § 1692g(b). Continued collection activity in the absence of validation, or any report to a credit-reporting agency without notice of dispute, will be treated as a violation of the FDCPA and any applicable your state debt-collection statute, and I will pursue statutory damages and attorney fees accordingly.
